NOWY — Terms of Service

These Terms of Service ("Terms") govern your use of map.nowy.io and related services (the "Service"), operated by Nowy Inc. ("Nowy," "we," "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

  1. Eligibility You must be at least 18 and able to form a binding contract. By using the Service, you represent that you meet these requirements.

  2. The Service Nowy provides tools that organize a creator's existing social media content into an interactive map and allow the creator to add affiliate and booking links. Nowy is an organizational tool; Nowy does not act as a travel agency, tour operator, or seller of travel, and does not process, fulfill, or guarantee any booking.

  3. Your Content and License Grant You retain ownership of your content. By connecting your account or directing Nowy to process your content, you grant Nowy a worldwide, non-exclusive, royalty-free license to access, store, reproduce, process, display, and distribute that content solely to operate and provide the Service (including generating, hosting, and displaying your map).

You represent and warrant that: (a) you own or have all rights necessary to grant this license; (b) your content does not infringe any third party's intellectual property, privacy, or other rights; and (c) your content does not violate any law or the terms of any platform (including Instagram/Meta) from which it originates. You are solely responsible for your content and for ensuring you have the right to use and share it.

  1. Affiliate Links, Bookings, and Disclosures The Service allows you to attach affiliate and booking links. You are solely responsible for complying with all applicable laws and disclosure requirements, including FTC guidelines on affiliate and sponsored content. Nowy does not guarantee any commission, conversion, or earnings. Any booking or purchase made through a link is a transaction solely between the end user and the third-party provider; Nowy is not a party to it and bears no responsibility for it.

  2. No Affiliation with Instagram/Meta Nowy is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. You are responsible for complying with Instagram's/Meta's own terms in connection with your use of your content.

  3. Acceptable Use You agree not to: use the Service unlawfully; upload content you do not have rights to; infringe others' rights; scrape, reverse-engineer, or overload the Service; upload malicious code; or misrepresent your identity or authority over an account.

  4. Fees and Future Paid Plans The Service currently offers a free tier. Nowy may introduce paid plans and change pricing at any time. Any paid features and their terms will be presented before you are charged. Nowy reserves the right to modify, add, or remove features and pricing.

  5. Intellectual Property The Service, including its software, design, and branding (excluding your content), is owned by Nowy and protected by intellectual property laws. Nowy's trademarks may not be used without permission.

  6. Third-Party Services The Service integrates with and links to third-party services. Nowy is not responsible for third-party services, their availability, content, or any transactions with them. Your use of them is governed by their terms.

  7. Disclaimer of Warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Nowy does not warrant that maps, place data, or third-party information are accurate, complete, or current, or that the Service will be uninterrupted or error-free.

  8. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOWY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. NOWY'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID NOWY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

  9. Indemnification You agree to indemnify and hold harmless Nowy from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

  10. Termination Nowy may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) survive.

  11. Governing Law and Disputes These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. (If you prefer mandatory arbitration and a class-action waiver — often even more protective — tell your lawyer; that's a decision worth making deliberately.)

  12. Changes to These Terms Nowy may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be reflected in the "Last Updated" date.
